1. About these terms

These terms apply to any booking or enquiry made directly through this website or by email with Voëlklip Villa, located at 118 Eleventh Street, Voëlklip, Hermanus 7200, Western Cape, South Africa. By making a booking you confirm that you have read, understood and agree to these terms.

2. The villa

Voëlklip Villa is a private holiday home consisting of five bedrooms, six bathrooms (five en-suite plus a guest toilet), a private pool on the front deck, three fireplaces, a fully equipped kitchen and indoor and outdoor entertaining areas. The villa sleeps a maximum of 11 guests in total, including children and infants.

3. Bookings and confirmation

Bookings are confirmed only once we have replied in writing and received the required deposit. An enquiry or booking request is not a confirmed reservation. Rates are quoted per night for the entire villa.

4. Deposits and payment

• A 50% deposit is payable to secure the booking.
• The balance is due 30 days before arrival.
• For bookings made within 30 days of arrival the full amount is payable on confirmation.
• A separate refundable breakage deposit may be required and is returned within 7 days of check-out, less any deductions for damage or loss.
• Payment is accepted by EFT or by card through our booking system.

5. Cancellations and changes

Cancellations made more than 60 days before arrival are eligible for a full refund of the deposit, less any unrecoverable bank charges. Cancellations made between 30 and 60 days before arrival forfeit the 50% deposit. Cancellations made within 30 days of arrival forfeit the full booking amount. Date changes are accommodated subject to availability and rate differences. We strongly recommend that guests take out independent travel insurance.

6. Check-in and check-out

• Check-in: from 14:00 on the day of arrival.
• Check-out: by 10:00 on the day of departure.
• Early check-in or late check-out is subject to availability and prior arrangement.

7. House rules

• The maximum occupancy is 11 guests at all times.
• No smoking is permitted inside the villa. Smoking is permitted on the outdoor terraces only.
• Small, well-behaved pets are welcome by prior arrangement only. Guests are responsible for any damage caused by pets.
• No parties or events without our prior written consent.
• Quiet hours apply between 22:00 and 07:00 out of respect for neighbours.
• The pool is unfenced. Children must be supervised by a responsible adult at all times.
• The braai facilities and fireplaces must be used responsibly. Never leave open flames unattended.

8. Damage, loss and conduct

Guests are responsible for the property and its contents during the stay. Damage, loss or excessive cleaning requirements may be deducted from the breakage deposit, or invoiced where the cost exceeds the deposit. We reserve the right to ask guests to leave the villa, without refund, where house rules are seriously breached.

9. Liability

Guests use the villa, the pool, the braai areas and any equipment at their own risk. To the extent permitted by South African law, Voëlklip Villa, its owners and managers are not liable for any injury, loss or damage suffered by guests or their property during the stay, except where caused by our gross negligence or wilful conduct.

10. Force majeure

Where a booking cannot proceed due to circumstances genuinely beyond our control (including natural disasters, government-imposed travel restrictions, prolonged power or water outages declared a state of disaster, or similar events), we will work with you in good faith to reschedule the stay or refund any payments we have not already incurred costs against.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be referred to the courts of competent jurisdiction in the Western Cape.
